Protest Application
A Protest Petition is a statement of dissatisfaction made to a Magistrate concerning a police report. It is not defined in the Criminal Procedure Code; however, it is an essential aspect of criminal law practice. When a person complains to the Magistrate under Section 156(3) of the Cr, pc, the Magistrate may, after being satisfied with the complaint, order the police to investigate.
After the investigation, the police submit a report to the Magistrate under 173(2) of the Cr.Pc. If the complainant is unsatisfied with the police report, they may file a Protest Petition to the Magistrate, stating their dissatisfaction and asking for further investigation under Court supervision. They may also request further proceedings under Sections 200 and 202 of the Cr.Pc. If the Protest Petition is accepted, the Magistrate may take cognizance of the case under Section 190 of the Cr.Pc and will issue a notice to the accused. The Magistrate may accept the final report and reject the Protest Petition, get the final report and treat the Petition as a Complaint and process it under Sections 200 and 202 of the Cr.Pc, or contact the Petition, reject the final report, and take cognizance under Section 190 of the code.
The Magistrate is not bound to accept the final report submitted by the police and can take cognizance based on the documents submitted with the police report. To file a Protest Petition, the police must send a report to the Magistrate, who then can examine the victim or witness, reopen the investigation, and take cognizance of the case if the complaint is not false. The Protest Petition must satisfy the requirements of a Complaint under Section 2(d) of the Cr.Pc before the Magistrate can issue a summons.
