FIR
FIR stands for First Information Report. It is a written statement made by the aggrieved person or any other person to the police officer on duty about a cognizable offence that has been committed.
According to Section 154 of the Code of Criminal Procedure, 1973, the information must be written, and the substance of the information must be entered in a book to be kept by the officer. The informant shall also be given a copy of the information free of cost.
To constitute an FIR, these two conditions must be fulfilled:
- The information must be about the commission of a cognizable offence and must be given in writing.
- The informant must also sign the information to be held responsible for the statement they have made.
Refusal to sign the FIR is punishable under Section 180 of the Indian Penal Code. Anyone can file an FIR, and it should be filed in the police station of the area where the offence has occurred. FIRs should be filed as soon as possible as this is the best way to get accurate information about criminal activity and to ensure that the evidence is not forgotten or embellished.
Following are the reports or statements which do not amount to an FIR:
- A report or a statement is recorded after the investigation’s commencement (sections 162 and 163 of the Code of Criminal Procedure, 1973).
- Reports were not recorded immediately but after questioning of witnesses.
- Reports were recorded after several days of developments.
- Information not about the occurrence of a cognizable offence but only a cryptic message in the form of an appeal for immediate help.
- Complaint to the Magistrate.
- Information to beat the house.
- Information to the Magistrate or police officer on the phone.
- Information was received at the police station before the lodging of an F.LR.
